Retirement Benefits in Bankruptcy

Perhaps you have a former employer that went out of business. Information for participants about employee benefits is located on the DOL web site. The EBSA has created a resource for such situations at http://www.dol.gov/ebsa/newsroom/fsbankruptcy.html. The site addresses other benefits, but it does discuss how participants become fully vested when a retirement plan is terminated. It also touches on PBGC insured benefits for those applicable plans.
